Transactions for Physical Goods
Where the Company makes physical goods such as consumer electronics, hardware and other physical goods (“Goods”) available on the AppDirect Marketplace, the following terms apply:
- Company shall legally procure and source the Goods. Company shall comply with any requirements from manufacturers or resellers of Goods (such as pricing and applicable territorial restrictions).
- Company shall be solely responsible for returns, warranty claims or chargebacks for Goods.
- Company shall be solely responsible for (i) inventory/stock management; (ii) shipping (incl. fees, customs and duties) as well as contracts and relationships with shipping services providers; and (iii) fulfillment for transactions of Goods. Third-party integrations for the above may require additional configuration and professional services.
- Company shall notify AppDirect of applicable fees and charges for the Goods (e.g. recycling fees).
- Company may bundle the Goods and/or associated services. Company shall notify AppDirect of additional bundles prior to making them available to the public for configuration and validation by AppDirect.
- Any localization or customization request or requirement shall be notified to AppDirect (e.g. local requirements for consumer protection). Configuration may require additional configuration and professional services.
Transactions for Goods remains subject to the Subscription Services Agreement or Self-Serve Agreement.
